Welcome to MindEdu. These Terms and Conditions govern your access to and use of the MindEdu website, platform, and related services. By accessing or using MindEdu, you agree to these Terms. If you do not agree, please do not use the website or services.
1. About MindEdu
MindEdu is an educational support platform designed to help schools strengthen early student support through a safe, structured, and non-diagnostic approach. The platform is intended to support visibility, documentation, organization, and educational follow-up within schools.
MindEdu is not a clinical diagnostic service, medical provider, emergency service, or legal decision-making tool.
2. Acceptance of Terms
By using the MindEdu website, requesting a demo, creating an account, accessing the platform, or using any related services, you confirm that you have read, understood, and agreed to these Terms and Conditions, along with our Privacy Policy and any other applicable policies or agreements.
If you use MindEdu on behalf of a school, company, or other institution, you represent that you are authorized to act on behalf of that entity.
3. Eligibility and Authorized Use
MindEdu is intended for lawful use by authorized individuals and institutions. Access to certain parts of the platform may be restricted to approved school personnel, administrators, counselors, safeguarding staff, or other authorized users.
You agree to use MindEdu only for proper educational, administrative, and professional purposes and not for any unlawful, harmful, misleading, or abusive activity.
4. Nature of the Service
MindEdu provides tools, workflows, and platform features intended to support schools in organizing observations, identifying patterns, strengthening internal visibility, and improving professional follow-up.
All outputs, indicators, summaries, and platform-generated insights are intended as supportive educational tools only. They do not constitute:
- medical advice,
- psychiatric or psychological diagnosis,
- therapy,
- legal advice,
- safeguarding decisions by themselves,
- disciplinary conclusions by themselves,
- or any other high-stakes determination without human review.
All use of MindEdu must remain subject to appropriate human judgment, professional interpretation, and school-level responsibility.
5. School Responsibility
Where MindEdu is used by a school or institution, the school remains responsible for:
- deciding what information is entered into the platform,
- ensuring lawful and appropriate use of data,
- assigning authorized personnel to review platform outputs,
- interpreting information within the school’s own educational and professional context,
- obtaining any permissions, notices, or consents required under applicable law or school policy,
- making final decisions independently of the platform.
MindEdu supports professional processes, but does not replace them.
6. Accounts and Access
If you are given access credentials for MindEdu, you are responsible for maintaining the confidentiality of your login information and for all activity that occurs under your account.
You agree not to:
- share login credentials improperly,
- allow unauthorized persons to access restricted areas,
- attempt to interfere with system security,
- copy, misuse, or exploit the platform beyond authorized use.
We reserve the right to suspend, restrict, or terminate access where misuse, security concerns, or breaches of these Terms are suspected.
7. Acceptable Use
You agree not to use MindEdu in a way that:
- violates any law or regulation,
- infringes privacy, confidentiality, or intellectual property rights,
- harms the platform, its users, or its reputation,
- introduces malicious code, unauthorized automation, or security threats,
- misrepresents the platform as providing diagnosis or guaranteed outcomes,
- uses the platform as the sole basis for medical, legal, disciplinary, or other high-risk decisions.
MindEdu must be used responsibly, professionally, and within its intended scope.
8. Intellectual Property
All content, branding, software, structure, design elements, workflows, text, graphics, logos, and platform features associated with MindEdu are owned by or licensed to MindEdu unless otherwise stated.
You may not reproduce, copy, distribute, modify, reverse engineer, republish, or commercially exploit any part of MindEdu without prior written permission, except to the extent necessary for authorized use within your institution.
9. User Content and Institutional Data
Where users or schools upload, submit, or enter information into MindEdu, they remain responsible for ensuring they have the right and authority to do so.
By submitting content or data to the platform, you grant MindEdu the limited right to process, store, display, and use that information only as necessary to provide the service, maintain functionality, support security, and fulfill contractual or operational obligations.
MindEdu does not claim ownership of school-owned or user-submitted institutional records. However, users and schools are responsible for the legality, accuracy, and appropriateness of the content they provide.
10. Privacy and Data Protection
Your use of MindEdu is also governed by our Privacy Policy. We are committed to responsible handling of information, but schools and authorized users also carry responsibilities regarding lawful data use, institutional governance, and appropriate permissions.
Where a separate agreement exists between MindEdu and a school, that agreement may provide additional terms concerning data handling, privacy, confidentiality, retention, and institutional responsibilities.
11. Website Content and Accuracy
We aim to present clear, accurate, and professional information on the MindEdu website and platform. However, we do not guarantee that all content will always be complete, current, or error-free.
We may update, revise, improve, or remove content, features, or services at any time without prior notice.
12. Availability of Service
We aim to provide a stable and reliable service, but we do not guarantee uninterrupted or error-free operation at all times. Access may be affected by maintenance, updates, technical issues, hosting interruptions, security matters, or factors beyond our reasonable control.
We may suspend or modify the platform or parts of it where necessary for operational, security, legal, or service improvement reasons.
13. Third-Party Services
MindEdu may rely on third-party services, hosting providers, plugins, integrations, analytics tools, email services, or technical infrastructure providers. We are not responsible for the independent terms, policies, or interruptions of third-party services, though we seek to work with appropriate providers in support of service delivery.
14. Disclaimer
MindEdu is provided on an “as is” and “as available” basis to the maximum extent permitted by law. While we aim to provide a valuable, careful, and professionally responsible service, we do not warrant that:
- the service will always be uninterrupted or error-free,
- every output will be complete or suitable for every context,
- the platform alone will prevent risk, resolve concerns, or produce any guaranteed institutional outcome.
MindEdu is a support platform, not a substitute for qualified human professional judgment.
15. Limitation of Liability
To the maximum extent permitted by applicable law, MindEdu shall not be liable for any indirect, incidental, consequential, special, punitive, or business-related losses arising from use of the website, platform, or services.
MindEdu’s total liability in connection with the use of its services shall be limited to the amount paid, if any, for the relevant service period, unless otherwise required by law or specifically agreed in writing.
Nothing in these Terms excludes liability where exclusion is not legally permitted.
16. Indemnity
You agree to indemnify and hold harmless MindEdu, its owners, team members, contractors, and affiliates from claims, liabilities, losses, or expenses arising from:
- your misuse of the platform,
- your violation of these Terms,
- your unlawful or unauthorized use of data,
- your infringement of the rights of any third party.
17. Termination or Suspension
We reserve the right to suspend, restrict, or terminate access to MindEdu at any time where:
- these Terms are breached,
- misuse is suspected,
- security concerns arise,
- required payments are not made where applicable,
- continuation of access presents legal, operational, or reputational risk.
Upon termination, relevant provisions concerning privacy, confidentiality, intellectual property, liability, and other surviving obligations shall continue as applicable.
18. Changes to These Terms
We may update these Terms and Conditions from time to time. Updated versions will be posted on this page with a revised effective date. Continued use of MindEdu after such updates constitutes acceptance of the revised Terms.
